Nebraska's New Medical Cannabis Program
A Hotbed for Midwest Cannabis Opportunity and Ongoing Pushback
In November 2024, Nebraskans finally voted to regulate medical marijuana (cannabis) throughout the Cornhusker state. Measure 437 legalized possession of up to five (5) ounces of medical cannabis via a written recommendation from a healthcare practitioner. Measure 438 allows for the regulation of medical cannabis through the creation of the Nebraska Medical Cannabis Commission, with members coming from the Nebraska Liquor Control Commission.
Despite the results being certified on December 2, there has been a myriad of pushback ahead of the results moving into law on December 12. Despite a number of appeals from officials looking to overturn the will of the people, we’re confident medical cannabis will be coming to Nebraska in some form.
How To Win A Nebraska Cannabis License
It’s still early in the program process to determine what will be required or how cannabis licensing applications will take place. Current timetables suggest a patient registration process in place by July 2025 and patient registrations set for October 2025.
Business license applicants will most likely still be required to submit business plans, operational plans, as well as financial projections to be as part of the licensing process so it’s imperative you start planning well ahead of any official timeframes.

The Potential For Limited Licensing & Community Power
If one thing is for certain, Midwest states (and especially Nebraska) hold their communities tight. What may be acceptable or promoted in one part of a state may be a far cry in others. Based on the uphill battle we've seen just to get a medical cannabis program on the ballot, it would come as no surprise if local Nebraska communities hold a say as to whether medical cannabis will be accepted in certain areas of the state. Ongoing struggles may also translate to limited licensing overall, as the program attempts to gain initial traction.
Understanding your local community, its common goals, real estate opportunities, and overall views on cannabis may be the largest differentiator when it comes time to apply for a Nebraska cannabis license.
A State Bringing Change to The Plains
With neighbors Colorado and Missouri the only ones to offer adult-use cannabis programs, Nebraska may be standing alone in its journey to build a new cannabis industry. South Dakota, Wyoming, Kansas, and even Iowa have all had their own struggles to get programs started. Nebraska could bring the changing tied to these areas, but it will require its own independence with a successful program first.
