South Dakota made history with voters passing both medical marijuana and adult-use at the same time in the November 2020 election. The laws take effect on July 1, 2021.
While regulators are developing the program details and regulations, cannabis entrepreneurs who hope to win a license should start planning now. Measure 26: Medical Marijuana
The South Dakota Department of Health is required to enact rules related to implementing the medical marijuana program by October 29, 2021. Four license types will be awarded: Cultivation, Wholesale/Processing, Retail, and Lab/Testing. Patient registration cards will be issued starting November 18, 2021.
Amendment A: Adult-Use Cannabis
This state constitutional amendment requires the South Dakota State Legislature to pass laws providing for an adult-use cannabis program by April 1, 2022. Under the measure, the Department of Revenue will adopt rules and regulations to implement the amendment, including the issuance of licenses and health and safety requirements. The measure authorized the Department of Revenue to create four license types: Commercial Cultivators, Testing Facilities, Wholesalers, and Retail Stores.
Amendment A also authorized local governments to enact regulations including number licenses and permitted locations.
