Colorado Natural Medicine Applications are Available Now

The application window to become a part of Colorado’s Natural Medicine program is open and we have plenty of details to offer about the application and licensing process.

 

Available License Types

There are six different types of licenses available as part of the state’s application program. These licenses include the following:

1) Healing Center

The physical location which permits a facilitator to provide and supervise Natural Medicine Services for a participant.

2) Cultivation

The physical location where regulated Natural Medicine is grown, harvested, and prepared in order to be transferred and distributed to either a Healing Center, Facilitator, a Natural Medicine Products Manufacturer, or to another Natural Medicine Cultivation Facility.

3) Testing Facilities

A public or private laboratory licensed, or approved by the Natural Medicine Division, to perform testing and research on regulated Natural Medicine and Natural Medicine products.

4) Product Manufacturers

A person who manufactures regulated Natural Medicine Products for transfer to a Healing Center, Facilitator, or to another Natural Medicine Products Manufacturer.

5) Business Owners

All proposed Owners of a Natural Medicine Business must apply for and obtain an Owner License.

6) Natural Medicine Handlers

A person who is not a Business Owner but who has unrestricted access to Regulated Natural Medicine or Regulated Natural Medicine Product or handles Regulated Natural Medicine or Regulated Natural Medicine Product.

 

Which License Type is Right For You?

An important item to note is that while you may be interested in one or more of these license types, you need to assess which ones you can apply for. Restrictions on licenses exist to deter vertical integration and conflicts of interest. For example, an owner of a testing facility cannot hold a financial interest in a healing center, a cultivator, or a manufacturer. Before submitting your application(s), be sure they’re the right ones and the applicable for your business intention.

Applying For Your Natural Medicine License

Once you’ve identified what your Natural Medicine business will look like, you’ll want to submit an application, or perhaps multiple applications. You can apply online as a business or as an individual, or fill out a hard copy of the application and submit this in person or by mail with all attachments and requisite fees.

Step 1: Select the License Type You’ll be Pursuing

Having made this key decision, you’ll need to submit your contact information details; ownership structure; other interests (such as a real or personal property lease; secured or unsecured promissory notes; agreements with a Natural Medicine business regarding intellectual property; or management agreement(s) with the Natural Medicine business); and a yes or no section. 

Step 2: Gather Your Additional Application Materials

Documentation to support your Natural Medicine business includes the following:

  • An organizational chart
  • Certificate of Good Standing
  • Organizational Documents, which could include the following: Articles of Incorporation, By-Laws, Shareholder agreement, Operating Agreement for LLC, or Partnership Agreement for partnership
  • E S G: Environmental Social Governance Plan
  • Proof of Possession of Licensed Property, which could include the following: Deed, Lease, Sublease, Rental Agreement, or Contract
  • Facility Diagrams, which would include a Premises Diagram (interior and exterior), and a Security Plan along with:
    • Documentation demonstrating that the address for the proposed Licensed Premises is permitted under the Local Jurisdiction’s applicable zoning laws for the cultivation, manufacturing, testing, storage, distribution, transfer, and/or dispensation of Regulated Natural Medicine and Regulated Natural Medicine Product.
    • Licensed Premises (Healing Centers only- Exterior Layout): A diagram or map of the physical location for the proposed Licensed Premises demonstrating the proposed address for a Healing Center license is at least 1000 feet from a licensed child care center, preschool, elementary, middle, junior, or high school, or a residential child care facility, unless the location otherwise complies with section 44-50-302(1)(d)(I), C.R.S.
    • Licensed Premises (Interior layout): A diagram or map of common areas, such as lobbies, hallways, and bathrooms; Restricted Areas; and Administration Areas.
    • Security and Surveillance diagram (no later than 30 days after beginning operations.)
    • A copy of any contracts, agreements, equipment leases, financing agreement, or security.
  • Provide a list of any sanctions, penalties, assessments or cease and desist orders from the Division of Natural Medicine.

Step 3: Submit Your Application

You’ll want to make sure that the application is fully completed when submitted. All forms will need to be filled out and signed which includes the following forms:

  • Affirmation & Consent
  • Tax Check Authorization
  • Applicant’s Request to Release Information

You’ll also need to fill out the required disclosures along with the application and compliance fees.
