Workforce + US Border

The US Customs and Border Protection (CBP) revised a statement in late September on admissibility factors for cannabis workers entering the US. The CBP official stance went from “may affect admissibility” to “coming to the U.S. for reasons unrelated to the marijuana industry will generally be admissible”. Since the CBP is the nation’s first line of defense for controlled substances entering the US, travel related to the cannabis industry may be deemed inadmissible. According to an immigration expert quoted in Forbes, it’s best to “stay off the radar”. Know before you go.

Cannabis and the Workplace

The Human Resources Professionals Association published a recent study exploring the impact of cannabis in the workplace focusing on four main areas: safety, employers’ duty, drug plans, and drug testing. The study cites a Deloitte poll that suggests up to 40% of the adult population in Canada either consumes cannabis at least on an occasional basis or indicated a willingness to try marijuana after legalization. Of the 650 HRPA members surveyed, 45% do not believe their current policies address potential legalization issues. Canadian Employment Law Today is looking forward to results of a government survey of over 2,000 workers at the end of the year to provide a clearer picture of cannabis in the workplace.
