USVI Announces March 31 Application Window for Cultivators

The U.S. Virgin Islands (USVI) is gearing up to finally launch its adult-use cannabis industry, over 4 months after it was meant to open the first application round. The Office of Cannabis Regulations (OCR) announced that license applications for cannabis cultivation and micro-cultivation licenses will open on March 31, 2025. Prospective cultivators will have a 60-day window to submit their applications, marking a significant opportunity to participate in this intriguing emerging market.

OCR License Limits

The OCR has established specific license categories and limits to ensure a structured rollout of the cannabis industry:​

  • Cannabis Cultivation Licenses: These licenses are allocated based on island-specific caps:​
    • St. Croix: 15 licenses​
    • St. John: 5 licenses​
    • St. Thomas: 15 licenses
  • Micro- Cultivation Permits: Designed for small-scale growers, these permits are not subject to license limits and issued on a rolling basis. Permit holders can cultivate up to 50 flowering cannabis plants and 200 immature plants simultaneously. ​

Application Requirements

Applicants must prepare comprehensive documentation to meet the OCR’s stringent criteria. The OCR has stated that there will be no page limits on the application itself so, because of the merit-based, competitive nature of this licensing round, you’ll want to be sure nothing is left out.   • Proof of Residency: Documentation verifying that the majority ownership meets USVI residency requirements.
  • Source of Funds: Detailed records demonstrating the lawful origin of all funds used in the business.
  • Possession of Proposed Licensed Premises: Evidence of ownership or lease agreement for the cultivation site, compliant with zoning regulations.
  • Detailed Diagram of Proposed Licensed Premises: Comprehensive layout plans of the cultivation facility.
  • Emergency Response Plan: Strategies for handling emergencies, including natural disasters and security breaches. ​
  • Business Plan: An in-depth plan outlining operational strategies, market analysis, and financial projections. ​
  • Cultivation Plan: A plan to provide a steady, uninterrupted supply of cannabis to cannabis dispensaries and cannabis manufacturers with thorough descriptions on cultivation processes.
  • Operations Plan: Detailed procedures for daily operations, cultivation methods, and compliance protocols. ​
  • Employee Training Plan: Programs to ensure staff are well-trained in compliance, safety, and operational procedures.
  • Security and Recordkeeping Plan: Measures to safeguard the facility and maintain accurate records, including surveillance systems and inventory tracking.
  • Product Safety and Labeling Plan: Protocols to ensure product quality and compliance with labeling regulations. ​

Additionally, applicants must undergo fingerprinting and background checks, disclose any civil litigation or criminal convictions, and provide financial documentation to demonstrate stability and compliance.
