Virginia Cannabis Update: Spanberger Proposes Delay to Adult-Use Sales Launch

If there is one thing we have learned in the cannabis space it’s that we should have patience. Things will almost always take longer than anticipated, or hoped, and that is what the case very well may be in Virginia. Here is the latest from the Commonwealth.

What’s Going On?

Patience will be vital in the coming days as we saw on April 13, Governor Abigail Spanberger announced that she was instead of signing the bill to legalize the framework for adult-use cannabis, she instead was seeking  two main amendments for SB542.

With this announcement of amendments, the Virginia Assembly will now reconvene on April 22. They can either approve or reject these amendments. They also have the power to override a veto from the Governor with a two-thirds majority vote should that occasion arise. After passage of a revised bill, Spanberger has until May 25 to sign.

What Are The Changes?

There are two significant amendment changes being request by Spanberger. These are:

  • Tax revenue distribution.

This would see adjustments made to how cannabis tax revenue is allocated once the market is operational.

  • A delayed sales launch.

This is not welcome news, but there could be some optimism to be found here. The Governor is proposing a retail sales launch date of July 1, 2027 as opposed to January 1, 2027. In a press statement, her office indicated that thus would help launch a safer legal market and allow for more time to combat the illicit market throughout Virginia.

What Can We Do Now?

What this means moving forward is that, unfortunately, we have to be patient. We are confident that Spanberger is interested and invested in getting the program off the ground and running, and for savvy entrepreneurs, this could create additional opportunity to prepare for their cannabis business.

A delayed start can allow businesses more time to organize their finances, identify a property, and build out a team.
