Licenses Award Process: Combined Lottery and Merit
Nebraska is a bit of a unique case when it comes to how states have rolled out their respective cannabis programs. Normally we see states or territories either use a lottery system (like Kentucky) or a merit based one (like the U.S. Virgin Islands). Nebraska thought, why not both?
There is a lottery component to the licensing. Applicants will submit development plan materials and then a select number will be pulled from this lottery (if there are more applicants than licenses to be awarded) and from these pulled, the Nebraska Medical Cannabis Commission (MCC) will review and evaluate the applicants.
Nebraska Has Already Rejected Some Applications
As we saw in the recent cultivation licensing round, the Nebraska MCC determined that to be awarded a cannabis license, an applicant needs to score at least an average of 70 out of 100-points. There are to be four cultivation licenses issued statewide and four applications were pulled from the random lottery. However, two of the applications were rejected as they did not meet the 70 out of 100-point average. The other two were awarded licenses.
What this reveals to us is that the Nebraska MCC is reviewing applications carefully and will reject cannabis license applicants if they do not submit materials that can pass muster.
